Terms of Use

1. Agreement and operator

These Terms of Use ("Terms") are between you and A & A Design Inc., doing business as Ludicrous Designs ("we," "us," or "our"), and govern SunShift for iPhone and iPad and our related website. By using SunShift, you agree to these Terms to the extent permitted by applicable law. Apple’s Standard EULA governs the app license and applies alongside these Terms. If they conflict, the Apple Standard EULA controls for the app license and Apple-required terms; mandatory consumer law always applies.

2. Eligibility and responsible use

You must be at least 13 and able to form a binding agreement under the laws where you live. If you have not reached legal adulthood, a parent or guardian must review these Terms and give any required permission. A higher local minimum age applies where required. You are responsible for securing your device and Apple Account and for the accuracy of information you enter. No traveler account is required.

3. What SunShift does

SunShift uses itinerary details, time zones, sleep preferences, and other choices to suggest travel-adjustment plans. Guidance may cover sleep, waking, light exposure or avoidance, meals, movement, caffeine, naps, and optional supplements. Body-clock estimates and planning outcomes are approximations. Actual responses depend on individual circumstances, travel changes, sleep, health, and other factors. We do not promise that a plan will prevent or cure jet lag, improve performance, or produce a particular result.

Forecasts, sunrise and sunset estimates, camera-based light-color estimates, calendar imports, flight data, and notifications may be unavailable or inaccurate. A camera estimate is not a calibrated lux meter, a measurement of circadian effectiveness, or a safety test for a light source. You remain responsible for assessing your surroundings and following authoritative travel and health advice.

4. Health and safety

SunShift provides general educational and wellness information, not medical advice, diagnosis, treatment, or emergency services. It is not intended as a medical device or a substitute for a qualified clinician who understands your circumstances. Consult a clinician before supplements, bright-light strategies, or major sleep changes, particularly if you take medications, are pregnant or breastfeeding, have a relevant medical condition, or perform safety-sensitive work. Never change prescribed treatment based on the app.

Stop or adjust an activity if it feels unsafe or makes you unwell. Do not look directly at the sun or an unsafe light source, use the camera or app while driving, or follow a prompt that conflicts with safe travel, local rules, or instructions from a clinician, airline, employer, or authority. Protect adequate sleep before driving or operating equipment. If you believe you have an emergency, contact local emergency services.

5. Travel data and availability

Check airports, flight numbers, local dates and times, time zones, connections, and schedule changes against your airline and booking. Review imported details before creating a plan. SunShift is not an airline, travel agent, booking service, or source of immigration advice. It does not monitor your booking or guarantee notification of delays. Internet connectivity, permissions, provider allowances, supported devices, and third-party services may affect availability. Manual entry remains available when online lookup is unavailable. Your mobile or internet provider may charge for data.

6. Free access and Pro subscriptions

Your first trip plan is included without charge. Pro offers the additional features described at purchase, including access for additional trips, through weekly, monthly, or annual auto-renewable subscriptions. Prices, currency, full amount billed, billing period, and any eligible offer are shown in the app and Apple’s confirmation sheet before purchase. Each period provides the same Pro access unless the purchase screen expressly states otherwise. Do not assume that an annual price is a monthly charge.

Payment is charged through your Apple Account when you confirm. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, subject to Apple’s applicable rules. Your account may be charged for renewal within 24 hours before that period ends. Changes to pricing or subscription terms are handled with the notice and consent required by Apple and applicable law. We do not create an additional subscription charge outside the App Store.

You can manage or cancel in Apple Account subscription settings. Cancellation generally stops the next renewal and access continues until the paid period ends, unless a refund, revocation, or applicable law provides otherwise. Removing the app or contacting support does not itself cancel a subscription. Where an eligible free trial or introductory offer is available, the app and Apple show its duration and subsequent charge; no offer is promised unless displayed for your account. Cancel before the applicable deadline to avoid renewal.

Use Restore Purchases with the Apple Account associated with an eligible purchase. Apple determines refund eligibility and processes refunds through Report a Problem, subject to your statutory rights. RevenueCat helps us deliver the paywall and synchronize subscription status; Apple StoreKit verifies app access. A temporary network or service problem may delay status updates. Contact support if a verified purchase does not unlock its features.

7. Privacy and optional permissions

The Privacy Policy explains device storage, purchases, service providers, optional analytics, permissions, and rights. Permission to use optional calendar, camera, location, notifications, or product analytics is not required to purchase Pro. A Terms update is not consent to optional data collection. You may change permissions and data-sharing choices as described in the app and policy.

8. License, ownership, and acceptable use

Your app license is governed by the Apple Standard EULA and Apple’s Usage Rules, including any applicable Family Sharing rules. SunShift’s software, design, graphics, brand, and content belong to us or our licensors. You retain rights in information you enter. You may not redistribute the app or content beyond the license; bypass lawful access restrictions; interfere with or overload the service; introduce malware; use the service unlawfully; or infringe others’ rights. Restrictions on reverse engineering apply only to the extent allowed by law.

You may voluntarily send suggestions. You give us permission to use that feedback to improve our products without an obligation to compensate you. This does not transfer ownership of your personal information or authorize public identification of you without permission.

9. Third-party services and links

SunShift uses Apple and RevenueCat for subscriptions, Apple for weather and platform features, Google for analytics only if enabled, and may use flight-service providers described in the Privacy Policy. Our website uses HostGator. Third parties operate under their own terms, and their services may change or stop. We remain responsible for obligations that applicable law places on us; these Terms do not remove those obligations. External links are offered for convenience and do not mean we endorse every part of another site.

10. Updates, suspension, and ending use

We may make reasonable updates to improve the service, address errors or security, meet legal or platform requirements, or respond to provider changes. We may restrict misuse or unlawful activity and provide notice when reasonably possible. For a material change affecting paid access, we will provide any notice, remedy, or cancellation rights required by law. You may stop using SunShift at any time and separately cancel renewal through Apple. Pro access ends when the entitlement expires or is revoked. Ownership, accrued obligations, and provisions intended to survive continue as permitted by law.

11. Warranties and consumer protections

To the extent permitted by law, SunShift is provided “as is” and “as available.” We do not warrant uninterrupted availability or that its data, estimates, or plans are error-free or suitable for your individual circumstances. To the extent lawful, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes mandatory guarantees, remedies, or other consumer rights. Where your law provides guarantees for digital content or services, those protections apply. Any warranty and refund responsibilities concerning Apple are governed by the Apple Standard EULA and applicable law.

12. Limits of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive losses, including lost profits, lost data, missed travel, or substitute-service costs arising from use of SunShift. Our aggregate liability relating to the app is limited to the greater of US$100 or the amount you paid for SunShift during the 12 months before the event giving rise to the claim, only where that limitation is lawful.

These limitations do not apply to liability that cannot lawfully be limited, including applicable liability for fraud, willful misconduct, death or personal injury caused by negligence, or mandatory consumer protections. They do not affect remedies you have against Apple or another provider under applicable law or their agreements.

13. Apple-specific provisions

These Terms are with Ludicrous Designs, not Apple. We provide app maintenance and support; Apple has no obligation to provide it. The Apple Standard EULA allocates responsibility for warranty claims, product claims, intellectual-property claims, and legal compliance. Apple and its subsidiaries are third-party beneficiaries of the Apple-related terms and may enforce them. Use must comply with applicable export and sanctions laws and Apple’s Usage Rules.

14. Changes and general terms

We may revise these Terms prospectively by publishing an updated version and effective date. We will give further notice or obtain agreement where required. Continued use may indicate acceptance only where permitted by law; statutory rights to reject changes or end a contract remain available. If a provision is unenforceable, the remaining provisions continue. Failure to enforce a right is not a waiver.

The law and dispute provisions of the Apple Standard EULA govern the app license, subject to mandatory rights and any consumer entitlement to bring proceedings where you live. These supplemental Terms do not create a separate mandatory arbitration agreement or class-action waiver. We may transfer our business or rights only subject to applicable law and without reducing mandatory consumer protections.
